1. General Terms of Use
1.1. Access to and use of the ESNA – Europe Startup Nations Alliance, Associação (“ESNA”) website and the platforms made available by ESNA imply full acceptance of these General Terms of Use (“Terms”).
1.2. These Terms shall be interpreted and applied in conjunction with the provisions of the Privacy Policy and the Cookie Policy.
1.3. By accessing the ESNA website or any of the platforms made available by ESNA, the User expressly declares that understands and agrees to be bound by these Terms and by the applicable national and European legal provisions.
1.4. If the User does not agree with these Terms or any of their clauses, he/she/they must immediately cease browsing or interacting in any way with the website or with the platforms made available by ESNA. Unauthorised use constitutes a legal infringement and may subject the User to legal liability under applicable law.
1.5. ESNA reserves the right to amend these Terms at any time. The most recent version will always be published on ESNA’s website. Continued use of the website after publication of any changes will be deemed as tacit acceptance of the new terms.
Use and Access to the Website and Available Web Platforms
2.1. The User undertakes to use the ESNA website and the platforms made available by ESNA solely for the purpose of consulting publications, catalogues, reports, data, and other documentation made available by ESNA, with the objective of monitoring and supporting public policies in European member countries. Use of the ESNA website or its platforms for any other purpose is not permitted, unless previously and expressly authorised in writing by ESNA. In addition, the User agrees not to:
a) Use the website for fraudulent, unlawful, abusive, or offensive purposes;
b) Introduce viruses, malware, malicious code, or carry out any acts that compromise system security;
c) Attempt to access restricted areas, third-party accounts, or protected servers without authorisation;
d) Share their access credentials with unauthorised third parties, even if they belong to the User’s organisation;
e) Reproduce, copy, modify, or distribute any content from the website without prior written authorisation from ESNA;
f) Use website content for commercial or promotional purposes without prior written consent from ESNA;
g) Upload, transmit, or share content that infringes the rights of third parties or of ESNA itself;
h) Transmit false information or third-party information without their consent.
2.2. Breach of these rules may result in the suspension or cancellation of access accounts and potential legal liability for any harm caused to ESNA or to third parties.
3. Features for Registered Users
3.1. Certain areas and functionalities of the ESNA website are restricted to Registered Users, who must create a personal account by providing accurate and up-to-date information.
3.2. Only the following may be considered “Registered Users”:
a) Focal points, i.e., representatives appointed by each member state to act as national points of contact with ESNA;
b) Representatives of European Union institutions whose activities relate to ESNA’s activities; or
c) Others previously authorised by ESNA.
3.3. Functionalities currently available to Registered Users include:
i) Access to restricted content, specific documentation, and technical resources available on ESNA’s website and platforms;
ii) Submission of proposals, institutional forms, and participation in events and programmes promoted by ESNA.
3.4. The Registered User is responsible for adopting appropriate security and confidentiality measures in relation to their login credentials. Any misuse of the account must be immediately reported to ESNA, and the Registered User must request a password change via the website.
3.5. ESNA reserves the right to suspend or terminate accounts that violate these Terms, misuse the functionalities, or compromise or may compromise the integrity of the website or the platforms made available.
4. Intellectual Property
4.1. All content available on this website, including texts, images, logos, software, databases, and graphic elements, is the property of ESNA or of third parties, and its distribution by ESNA is duly authorised/licensed.
4.2. The User undertakes to fully respect the intellectual property rights of ESNA and third parties, refraining from reproducing, copying, distributing, modifying, transmitting, displaying, or otherwise using the content of the website without prior express written authorisation from the respective rights holder.
4.3. It is expressly prohibited to access, collect, extract, index, copy or otherwise use the content of this website through automated tools, including but not limited to web crawlers, data mining, scraping, or artificial intelligence technologies (such as machine learning or large language models), without prior express written authorisation from ESNA. Any unauthorised use of such technologies for reproduction, reuse, analysis, or training of artificial intelligence models constitutes a breach of these Terms and may give rise to civil and/or criminal liability under applicable law, including copyright and related rights legislation.
4.4. Use of this website does not confer on the User any ownership or licence rights over the content made available. Any unauthorised use shall be deemed an infringement of intellectual property rights and may result in civil and/or criminal liability under applicable law.
5. Disclaimer of Warranties
5.1. The website, the platforms made available, and the information contained therein are provided “as is” and “as available”, without any express or implied warranties. To the fullest extent permitted by law, ESNA makes no express, implied or statutory warranties, including, without limitation, warranties of fitness for a particular purpose, or that access to the website will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
5.2. The User assumes full responsibility and risk arising from the use of the website and the platforms made available, as well as the information contained therein. None of the information provided should be considered by the User as advice for any purpose, lobbying, or made available for any other purpose not covered by these Terms.
5.3. ESNA does not guarantee that the information is accurate, complete, or up-to-date, nor that the website or the platforms made available will operate continuously or without technical errors.
6. Limitation of Liability
6.1. Without prejudice to applicable legal provisions, ESNA shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the website.
6.2. This limitation applies even if ESNA has been advised of the possibility of such damages, except where liability is required by law.
7. Links to Third-Party Websites
7.1. The website may contain hyperlinks to external websites that are not controlled or operated by ESNA.
7.2. ESNA shall not be held responsible for the contents, policies, or privacy practices of such third-party websites, for their unavailability, or for any improper use.
8. Applicable Law and Jurisdiction
8.1. These Terms of Use are governed by Portuguese law.
8.2. In the event of a dispute, and in the absence of an amicable resolution, the courts of the district of Lisbon shall have jurisdiction, to the exclusion of any others, unless a different forum is imposed by mandatory legal provision.
